Partner Terms — IT Offerten

These terms govern the collaboration between IT Offerten and registered IT partner companies (hereinafter "Partner").

Scope

These terms apply to all companies that register as a partner on it-offerten.ch and purchase leads through the platform.

Pricing

The price per lead starts at CHF 100.00 (excl. VAT) and varies depending on the request and project complexity. There are no subscription fees or automatic charges — you only pay for leads you choose to purchase. IT Offerten reserves the right to adjust prices with 30 days' notice.

Billing and Payment

Leads are invoiced monthly. Invoices are sent by email as PDF with QR payment slip on the 1st of the following month. Payment is due within 30 days. No refunds are issued for purchased leads.

Data Protection

The partner agrees to use received customer data exclusively in connection with the respective quote request and to comply with the Swiss Federal Act on Data Protection (DSG).

Lead Usage

Lead data purchased through it-offerten.ch (contact details, project descriptions, etc.) may only be used by the purchasing partner company itself. Sharing, reselling, or forwarding lead data to third parties — including affiliated companies, subcontractors, or other business partners — is expressly prohibited. Violations entitle IT Offerten to immediately suspend the partner account.

Direct Relationship After Lead Purchase

Upon purchasing a lead, the partner receives the contact details of the requesting company. From that point, the business relationship takes place directly between the partner and the potential client. IT Offerten is not a contracting party, intermediary, or advisor in the subsequent business negotiations and assumes no responsibility for offers, negotiations, or contracts between the partner and the client.

Termination

The partnership may be terminated by either party with 30 days' written notice (by email). Already purchased leads and outstanding invoices are not affected by termination.

Liability

IT Offerten's liability is limited to the amount of lead fees paid in the last 12 months. IT Offerten does not guarantee the quality or conversion of referred requests.

Warranty

IT Offerten does not guarantee the completeness or accuracy of data submitted by customers. Lead quality may vary.

No Agency Relationship

The partnership does not create any agency, employment, or representation relationship between IT Offerten and the partner.

Applicable Law and Jurisdiction

Swiss law applies. Place of jurisdiction is Solothurn, Switzerland.
